Engineer Certificates

Our technical construction office undertakes the issuance of Engineer Certificates for the legality of a properties, which will obligatorily accompany from now on all legal acts inter vivos pertaining to the transferring or introduction of real rights on an estate, including land which has not been built on. As per Ν.4495/2017, attached to these legal acts must be a sworn statement by the owner and an Engineer’s Certificate stating and certifying respectively acording to article 83 of Ν.4495/17 that:
a .there is no building on the estate, or
b . there are no arbitrary constructions exceeding the actual building, the coverage and the height of the property, and there has been no unlicensed usage, on the estate or on the distinguished integral horizontal or vertical property, excepting common possessions or communal spaces, or
c . the esxisting constructions or the arbitrary usage of the space, come under one of the excluding clauses of paragraph 2 of article 82 and are therefore not ruled by any other conditions of article 89 of Ν.4495/2017.
We must also point out concerning the Engineer Certificate that:

  • it is valid for two (2) months,
  • in certain cases it must be accompanied by a topographic diagram dependent on the state system of coordinates (EGSA 87),
  • in certain cases it may be necessary to first legalize or adjust or put in order any arbitrary constructions, as per the current legislation relating to arbitrary constructions and as per the recent indications of Ν.3843/10-Ν.4014/11 -Ν.4178/13 - Ν.4495/17 .
